Getting a Settlement

You may be wondering when your case will finally be settled.

Some cases settle quickly and others may take years. The timing often depends on which insurance companies are involved, the type of injury and how it happened. It can also take a long time for your case to come up. That's because the courts are backlogged with suits.

Sometimes, there are ways to speed up the process. If you or one of the witnesses is over 70, in poor health, or suffering extreme financial hardship, please let us know. The court may allow us to move ahead of other waiting cases.

To sue or not to sue?
Sometimes, we try to settle a case without having to file suit. That's because once a case has been "put into suit," the attorneys who represent the other side (usually the insurance company) are usually not in much of a hurry to reach a final disposition. Once they have the case, it probably will not be settled until the case comes up for an informal hearing called a "pre-trial." The pre-trial only happens after a lawsuit has been filed and most of the preliminary legal work has been completed, regardless of when the accident happened.
